House Approves Johnsen Plan to Reinstate ‘No Stricter Than Federal’ Safeguard

The Michigan House of Representatives has approved legislation sponsored by Rep. Gina Johnsen (R-Portland) to restore accountability and common sense in state rulemaking. House Bill 4160 prohibits state agencies from issuing regulations that go beyond federal standards unless they can prove a clear and convincing need, with facts documented on the public record.

Rep. Johnsen said the vote was a victory for transparency in government.

“Michigan cannot afford unelected regulators creating burdens that go further than Washington without proof,” Johnsen said. “This restores a simple principle. If agencies want tougher rules, they must justify them with facts.”

The plan maintains important exceptions for emergencies and special education while eliminating unnecessary red tape.

“Every extra layer of regulation makes it harder for small businesses to grow, for manufacturers to compete, and for families to get ahead,” Johnsen said. “By restoring these guardrails, we are keeping government accountable and making Michigan more competitive.”

Business and industry groups, including the National Federation of Independent Business and the Michigan Manufacturing Association, have joined in supporting the plan, highlighting the need for stability and predictability in Michigan’s regulatory environment.

HB 4160 now advances to the Michigan Senate for consideration.
